Minnesota has implemented new regulations requiring all organizations with employees who work a minimum of 80 hours in Minnesota to provide earned sick and safe time (ESST). The new ESST requirements include:

  • Providing the required paid time off
  • Notifying employees of the change
  • Including earned and used ESST balances on paystubs

Employers must comply with these and other regulations in the new law. Update your current policies and procedures to make sure your organization is prepared to follow the new rules.

Compliance and implementation considerations

Employer policy decisions to consider before implementing ESST include:

  • How will our current time-off policies interact with ESST?
  • How will ESST hours be earned (accrued over time or front loaded)?
  • What will happen with unused ESST hours at year-end?
  • What employment policies must be created or updated?
  • How must my payroll processes be updated or adjusted?
