Barry Sussman

Overview

Barry is a Principal in CLA's VFLI (Valuation, Forensic, Litigation and Investigations) practice, specializing in providing financial and accounting consulting in disputes and investigations. He has testified in U.S. District courts, U.S. Bankruptcy courts, state courts, and in front of arbitration panels. He has also served as an arbitrator in post-acquisition disputes. He has over 30 years of experience in calculating the value of damages events in complex commercial disputes, including intellectual property disputes, breach of contract matters, licensing disputes, and post- acquisition disputes.

Mr. Sussman also has significant experience investigating alleged accounting errors and irregularities in the financial statements of public companies, preparing valuations of business enterprises and intangible assets, performing royalty audits on behalf of licensors, and performing special accounting projects.

Prior to joining CLA, Mr. Sussman has held Managing Director, Director and partnership positions at several international consulting and accounting firms.

His areas of expertise include:

• Testifying as an expert on financial damages issues in intellectual property disputes involving patent, trademark and trade dress infringement, misappropriation of trade secrets, unfair competition, copyright and licensing disputes. Calculated lost profits and determined appropriate reasonable royalty rates. Assessed the accuracy and completeness of revenue reporting under royalty-related obligations of license agreements and advised clients regarding appropriate royalty rates in licensing negotiations.
• Testifying as expert on accounting and financial damages issues resulting from breach of contract, post-acquisition, and a variety of other claims. Calculated and rebutted damages in a wide variety of industries. Served as the sole arbitrator for accounting issues in post- acquisition disputes.
• Special accounting projects including investigations involving alleged errors and irregularities in the financial statements of public and private companies, due diligence in acquisition, and special purpose audits or analyses of financial information.
• Valuations of closely held business enterprises and intangible assets.
